Ninth Circuit Court of Appeals Vacates District Court Ruling in Planned Parenthood v. ACLA

National Association of Abortion Providers Urges Appeal of Decision that Allows Extremists to Put Abortion Providers in Harm's Way

"As the organization representing those who risk their lives to provide safe abortion services to women, we strongly disagree with today's decision," stated Vicki Saporta, Executive Director of the National Abortion Federation (NAF). "In the past decade, there have been seven murders and 17 attempted murders at the hands of anti-choice extremists. Physicians who have been listed on ACLA 'Wanted' posters have subsequently been murdered. Not only do these materials incite violence, but they provide the information necessary for extremists to target abortion providers for violence."

"This decision could result in increased levels of violence against the dedicated health care professionals who provide safe abortion services. The court states that parties who encourage or try to make it likely that others will assault abortion providers cannot be held liable for their threatening speech. This sets a dangerous precedent for future attempts by physicians to protect themselves from anti-choice extremists."

"The Ninth Circuit has reversed a decision made by a jury that listened to days of testimony and carefully considered the evidence before making their decision. We hope that the plaintiffs will appeal this decision," said Saporta.
