National Abortion Federation Emerges Victorious from Lawsuit against Its Public Education Campaign on Mifepristone (RU-486)

Plaintiffs Withdraw From Suit "With Prejudice"

Washington, DC - The plaintiffs in a lawsuit against the National Abortion Federation (NAF) over its public education campaign yesterday chose to withdraw their complaint from the Circuit Court of Cook County in Chicago, Illinois. As a result, the plaintiffs must pay all court costs and are prohibited from ever re-filing their suit against NAF.

"The withdrawal of the lawsuit clearly indicates that this case had absolutely no merit," said Vicki Saporta, Executive Director of NAF. "The plaintiffs demonstrated throughout the process that this frivolous lawsuit was brought forward solely to advance their anti-choice agenda."

The lawsuit claimed that NAF's public education campaign about mifepristone for early abortion was "deceptive" under Illinois law. The campaign ran in 14 national magazines from July through November 2001. The ad provides accurate information about the FDA-approved early abortion option and refers interested parties to NAF's website and national toll-free Hotline.

"The purpose of our campaign is to ensure that women facing an unintended pregnancy have the information and resources they need to make the decisions that are right for them," stated Saporta. "We remain dedicated to educating women about the full range of reproductive health care options."

The case was Nancy Koprowski, et al. v. The National Abortion Federation (No. 01CH12860). Representation was provided by Wilmer, Cutler & Pickering and the Roger Baldwin Foundation of the American Civil Liberties Union of Illinois.
