Despite Alito's Evasive Testimony, His Opposition to Roe v. Wade Remains Clear:
Statement of Vicki Saporta, President and CEO of the National Abortion Federation

During his confirmation hearings today, Samuel Alito failed to distance himself from his long history of hostility to reproductive freedom. He has done nothing to assuage our fears that, if confirmed, Judge Alito would vote to considerably weaken or even overturn Roe v. Wade.

Alito stated that his belief that the Constitution does not protect the right to an abortion was indeed an accurate representation of his legal philosophy in 1985. He also stated that stare decisis, the principle of following precedent, was not 'an inexorable command.'

In 1985 Judge Alito drafted a specific and detailed strategy memo for eviscerating Roe, outlining a plan for using the submission of a government brief in Thornburg v. American College of Obstetricians and Gynecologists to 'bring about the eventual overruling of Roe v. Wade.' Today he gave us no reason to think his beliefs have changed.
